1. Agreement to Terms

By accessing or using the website located at floridacashbackrealtor.com (the "Site") or by engaging the real estate buyer's agent services of Keith Lee, licensed Florida Real Estate Sales Associate (License No. SL3213486), operating under People's Choice Realty (collectively, "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms").

If you do not agree with any part of these Terms, you must discontinue use of the Site and our services immediately.

2. Services Provided

We provide licensed real estate buyer's agent services in the State of Florida, including but not limited to:

• Representing buyers in the purchase of residential real property in Florida
• Scheduling and coordinating property showings
• Preparing and submitting purchase offers on behalf of buyer clients
• Negotiating purchase terms and navigating the closing process
• Providing a commission cash-back rebate to qualified buyers at closing (see Section 4)

Our services are available to buyers located anywhere in the United States purchasing property in the State of Florida. We do not represent sellers.

3. Licensing & Brokerage Disclosure

Keith Lee is a licensed Florida Real Estate Sales Associate, License No. SL3213486, affiliated with People's Choice Realty. All real estate activities are conducted in accordance with Florida Statutes Chapter 475 and applicable rules of the Florida Real Estate Commission (FREC).

Nothing on this Site constitutes legal, financial, tax, or investment advice. You are encouraged to consult independent legal and financial professionals regarding any real estate transaction.

4. Cash-Back Rebate Program

4.1 Rebate Tiers

Rebate percentages are calculated as a percentage of the buyer's agent commission received at closing and are tiered by purchase price as follows:

• $400,000 – $499,999: up to 25% rebate
• $500,000 – $599,999: up to 30% rebate
• $600,000 – $699,999: up to 35% rebate
• $700,000 – $999,999: up to 40% rebate
• $1,000,000 and above: up to 50% rebate

4.2 Rebate Eligibility

To qualify for the cash-back rebate, the buyer must:

• Enter into a signed Buyer Representation Agreement with Keith Lee / People's Choice Realty prior to making an offer on any property
• Successfully close on a qualifying Florida residential property
• Ensure the rebate is not prohibited by their mortgage lender (buyers using certain loan programs may have limitations)
• Not be engaged with or previously represented by another real estate agent in connection with the subject property

4.3 Rebate Limitations

The rebate amount is based solely on the buyer's agent commission actually received at closing and may be reduced if the seller or seller's agent offers a commission lower than the standard market rate. Rebates below $400,000 are not offered under this program. We reserve the right to modify or discontinue the rebate program at any time for new clients.

5. Buyer Representation Agreement

Prior to providing active buyer's agent services (including scheduling showings, writing offers, or negotiating on your behalf), you will be required to sign a Buyer Representation Agreement as required under Florida law. This agreement outlines the scope of representation, compensation terms, and the rebate commitment specific to your transaction.

Submitting an inquiry form on this Site does not create an agency relationship. An agency relationship is only established upon execution of a signed Buyer Representation Agreement.

6. Website Use

6.1 Permitted Use

You may use this Site for lawful purposes related to researching and engaging buyer's agent real estate services. You agree not to use the Site in any manner that could damage, disable, or impair the Site or interfere with any other party's use of the Site.

6.2 Accuracy of Information

We make reasonable efforts to ensure the accuracy of information on this Site, including rebate calculations and program details. However, all figures, savings estimates, and rebate amounts shown on the Site are illustrative and for informational purposes only. Actual rebate amounts will vary based on purchase price and commission received.

6.3 Third-Party Links

This Site may contain links to third-party websites, including scheduling tools, CRM platforms, and listing portals. We are not responsible for the content or privacy practices of any third-party sites and encourage you to review their terms and privacy policies.

7. Communications & Contact

By submitting a contact or inquiry form on this Site, you consent to being contacted by Keith Lee / People's Choice Realty via phone, email, and/or SMS text message for the purpose of discussing your real estate needs. Message and data rates may apply. You may opt out of text communications at any time by replying STOP.

Submission of a form does not obligate you to retain our services, nor does it obligate us to represent you.

8. Privacy

Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell your personal information to third parties.

9. Disclaimers & Limitation of Liability

This Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, People's Choice Realty and Keith Lee disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Keith Lee or People's Choice Realty be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of this Site or our services, even if advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the total commissions or fees actually paid by you to us in connection with the transaction giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Keith Lee, People's Choice Realty, and their respective officers, agents, and representatives from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with your violation of these Terms or your use of this Site.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
